HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.383 of 2016 ORDER:

This petition is filed to withdraw F.C.O.P.No.12 of 2016 from the file of Family Court, Karimnagar, and transfer the same to Senior Civil Judge, Narsaraopet, Guntur District.

Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 07.03.2014 at Narsaraopet town and she joined respondent to lead marital life and that respondent made allegations causing mental agony which are highly defamatory in nature and due to disputes she is living with her parents house at Santhagudipadu Village, Rompicherla Mandal, Guntur District. She stated that respondent filed F.C.O.P.No.12 of 2016 at Karimnagar seeking dissolution of marriage. She stated that her father is an agriculturist, aged about 62 years, and distance between her place of residence and Karimnagar is more than 400 kms. and it is difficult for her to travel between these two places being a lady and that it will take minimum fifteen hours to cover these places. She further stated that she has no male member to assist or accompany her from her place of residence to Karimnagar and also she cannot bear the travelling expenses. For these reasons, she prayed for transfer of F.C.O.P.No.12 of 2016 from Family Court, Karimnagar to Senior Civil Judge, Narsaraopet.

This Court permitted petitioner to take notice on respondent through registered post with acknowledgment due and in compliance

SRK, J Tr.C.M.P.no.436 of 2016 of the said order, advocate for petitioner filed memo on 18.07.2016 stating that respondent received the notice and filed postal acknowledgment along with memo. In spite of service respondent neither appeared in person nor through any Advocate. 4.

Heard advocate for petitioner.

Considering the reasons stated in the affidavit filed in support of petition and also considering the convenience of wife, F.C.O.P.No.12 of 2016 is withdrawn from Family Court, Karimnagar, and transferred to Senior Civil Judge, Narsaraopet, Guntur District, for disposal in accordance with law.

Transfer C.M.P. is ordered accordingly.
