THE HON'BLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE NO.787 OF 2017 ORDER:
This contempt case was instituted alleging wilful disobedience to the order dated 26.04.2016 passed in W.P.No.14363 of 2016. By the said order, the authorities of the Greater Hyderabad Municipal Corporation were directed to take appropriate action on the complaints made by the writ petitioner on 18.04.2015, 19.06.2015 and 14.12.2015. These complaints were made in the context of the alleged illegal and unauthorised constructions being made by the unofficial respondents in the writ petition in an area earmarked for a park. The Deputy Commissioner, Moosapet Circle, Greater Hyderabad Municipal Corporation, filed a counter-affidavit stating that in terms of the aforestated order, proceedings were issued on 24.05.2017 after hearing both parties. A copy of the said proceedings has also been placed on record.
Perusal thereof reflects that the Deputy Commissioner, having considered the documents placed before him, opined that the writ petitioner had not shown any proof of encroachment over the park area warranting further action. He accordingly closed the complaints made by the petitioner.
In the light of the aforestated developments, it is clear that no inaction can be attributed to the municipal authorities in the context of the order passed in W.P.No.14363 of 2016. In the event the petitioner has any grievance with the proceedings dated 24.05.2017, he necessarily has to seek redressal thereof independently in accordance with law. The validity of the said proceedings cannot be made the subject matter of enquiry in this contempt case.
