THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.19375 of 2011 ORDER:

This writ petition is filed seeking the following relief/s: '...to issue a writ or direction preferably Writ of Mandamus declaring the action of the Respondent No.4 in forcibly taking over the possession of the office building of the Petitioner situated near ECIL Factory gate as illegal, arbitrary, discriminatory and violative of Rule of Law and also the fundamental rights of the members of the Petitioner Trade Union and consequently direct the Respondent No.4 to restore to the Petitioner the possession of the said office building and pass such other orders....'

2. I have heard the submissions of the learned counsel for the writ petitioner and the learned Standing Counsel appearing for the respondents 4 to 6. I have perused the material record.

3. The learned counsel for the writ petitioner submits that the then General Secretary of the writ petitioner-Union had retired from service and that there are no further instructions either from the present General Secretary or from the Office Bearers of the writ petitioner Union. Therefore, the learned counsel seeks permission to withdraw the writ petition with liberty to the writ petitioner-Union to file a fresh writ petition and seek appropriate relief, as and when necessary.

4. The learned Standing Counsel appearing for the respondents 4 to 6 would submit that he has no objection, if the writ petition is disposed of as sought for by the learned counsel for the petitioner.

5. Recording the aforesaid submissions, the Writ Petition is dismissed as withdrawn granting liberty to the petitioner-Union, as now sought for. There shall be no order as to costs.

Miscellaneous petitions pending, if any, in this writ petition shall

stand closed.
