THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13429 OF 2015 ORDER:

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioners/A.1 & A.2 seeking bail in connection with Crime No.394 of 2015 on the file of S.N.Puram Police Station, Vijayawada City registered for the offence under Section 489(B)(C) r/w 34 IPC.

Heard and perused the records.

The case of the prosecution is that the petitioners came to Vijayawada from Visakhapatnam and while they were trying to circulate the fake currency notes, they were caught hold by the police and they were found in possession of 101 fake currency notes totaling an amount of Rs.50,500/-. On enquiry, they have confessed to have purchased Rs.5.00 lakh worth fake currency for Rs.1.00 lakh original notes from one Murali and that they have exchanged almost all the notes leaving a balance of 101 notes that were seized from their possession.

Learned counsel for the petitioners submits that the petitioners have been implicated falsely in the case and that they were arrested on 29.10.2015 and since then they are in jail.

It is a case of circulating of fake currency and keeping in view of the fact that huge amount is involved, this Court is not inclined to grant bail to the petitioners at this stage.
