HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.11238 of 2015 ORDER:

This petition is filed by the petitioner-A1 under Sections 437 and 439 Cr.P.C. seeking to grant bail to him in Crime No.92 of 2015 on the file of Cumbum Police Station, Prakasam District, registered for the offence punishable under Section 6 of the Protection of Children from Sexual Offences Act, 2012 and Sections 323 and 324 r/w 34 IPC. Heard and perused the material available on record. It is alleged that since the wife of the petitioner died, he had requested the de facto complainant to send his daughter-victim girl, aged about 13 years, to his house to look after his children at Cumbum and he had gone to army and returned to Cumbum and had intercourse with the victim girl with a promise to marry her and by saying that she is the mother of his children. He shifted his family to Hyderabad and he continued his activities.

While he was searching for another woman to marry, the victim girl informed the same to the de facto complainant and when the de facto complainant questioned the petitioner, he along with A2 and A3 attacked him. On the report given by the de facto complainant, the petitioner was arrested on 12.9.2015. Taking into consideration the facts and circumstances of the case and the age of the victim girl, this Court is not inclined to grant bail to the petitioner.
