THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.11055 OF 2010 ORDER:

Heard the learned counsel for the petitioners. The prayer sought for in the writ petition is as under: "to issue a writ of certiorari declaring the action of the respondents in proposing to lay the Tar road through the petitioners land in Sy.No.270 of Nasarlapally village, Chinthapally Mandal, Nalgonda District, without acquiring and initiating land acquisition proceedings as arbitrary, illegal, unreasonable, violative of principles of natural justice and contrary to the provisions of Land Acquisition Act and violative of Art.14, 21, 300-A of Constitution of India."

During the course of hearing, the learned Government Pleader appearing for the respondents 1 to 3, informed the Court that the Social Welfare Department is nothing to do with the laying of the road as alleged in the writ petition, and if at all, any such proposal is there, it is either for the Panchayat Raj Department or for the Roads & Buildings Department.

Recording the above said submission, the writ petition is dismissed. It is needless to observe that if the proposal to lay the road is still in force, it is open for the petitioners to file a fresh writ petition and seek appropriate remedy as per law. No costs.
