THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.13764 of 2012 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to declare the inaction of respondents 1 & 2 as illegal and arbitrary and consequently direct respondents 1 & 2 to initiate action against respondents 3 to 5 in respect of the illegal construction of building in the petitioner's property to an extent of 120 square yards in Survey Nos.54 and 55, situated at Old Bowenpally Village on Plot No.27/part, New No.(Ward No.8) 7-171/10/part, Old Bowenpally Village, Balanagar Mandal, Kukatpally Municipality, Ranga Reddy District, bounded by: North: H.No.8-7-171/10/part on Plot No.27/part, South: Plot No.28, East: Plot No.24, West: 25 Feet Wide Road under registered sale deed, dated 19.10.2000, without obtaining permission and following due process of law.

Heard and perused the material available on record. Learned Standing Counsel for respondents & represented that as alleged by the petitioner, there is no illegal construction in the subject property of the petitioner. Learned Standing Counsel further submitted that if there is any illegal construction in the subject property of the petitioner, then respondents 1 & 2 will take appropriate steps, in accordance with law.

Recording the said submissions of the learned Standing Counsel for respondents 1 & 2, the Writ Petition is disposed of. No

costs. Consequently, miscellaneous petitions pending, if any, in this writ petition, shall stand closed.
