HON'BLE SRI JUSTICE SURESH KUMAR KAIT Writ Petition No.31621 of 2016 ORDER:

Vide present writ petition, the petitioners seek writ of Mandamus declaring the non-consideration of grant of renewal of permission to the 2nd petitioner Institution for the academic year 2016-17 by the respondents, as illegal and arbitrary.

2. Sri Vedual Venkataramana, learned senior counsel appearing on behalf of the petitioners submits that for the aforesaid relief, the petitioners made representations dated 23.08.2016, 29.08.20165 and 06.09.2016 for grant of renewal of permission for the 2nd petitioner Institution for the academic year 2016-17 and the first respondent has asked the 3rd respondent to place before the Oversight Committee on Medical Council of India, for consideration, however, till date their representations have not been placed before the said committee.

3. Learned senior counsel appearing for the petitioners submits that similar issue came before the Supreme Court in Writ Petition (Civil) No.273 of 2016, whereby the Supreme Court directed the Department to forward it to the Committee and the Committee may consider about the grievance of the petitioner.

4. Keeping in view of the averments made in the writ petition and the submission of the learned senior counsel appearing for the petitioners, I hereby direct the 3rd respondent to decide the representations made by the petitioners within two weeks from the date of receipt of a copy of this order. The decision taken thereon shall be

communicated in writing to the petitioners, within three days thereafter.

5. Needless to state that if the petitioners still aggrieved of the decision of the 3rd respondent, they may challenge the same before appropriate forum.

6. With the above direction, the writ petition is disposed of. No order as to costs. Pending miscellaneous petitions, if any, in this petition, shall stand closed.
