THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.6992 of 2012 ORDER:

The petitioner assails the action of the Revenue Divisional Officer, Jangareddygudem, West Godavari District, in instructing the police authorities to take action against him and his family members in relation to the agricultural land belonging to the 3rd respondent in certain survey numbers of Dharbhagudem Village, Jelugumilli Mandal, West Godavari District.

By order dated 15.03.2012, this Court directed the respondents to maintain status quo with regard to the possession over the subject land pending further orders.

The Sub-Inspector of Police, Jelugumilli Police Station, West Godavari District, filed a counter-affidavit stating that the Revenue Divisional Officer, Jangareddygudem addressed letter dated 22.10.2011 to the police authorities stating that the 3rd respondent had absolute rights over certain lands in Dharbhagudem Village and that certain villagers were obstructing the enjoyment of the 3rd respondent over the said lands. However, as the police authorities were of the opinion that the dispute was purely civil in nature, no action was taken by them. The Sub-Inspector further stated that the police authorities never interfered in the civil disputes between the petitioner and the 3rd respondent and that no case had been registered on the file of Jelugumilli Police Station in relation to any offence being committed as regards the subject lands.

In the light of the aforestated counter, it is clear that the police authorities are not interfering in the matter. The disputes of the petitioner and the 3rd respondent, if any, do not fall for consideration in

this writ petition. It is for them to seek redressal of such disputes, if any, before the competent forum in accordance with law. Making this position clear, the writ petition is dismissed. Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
