O R D E R

Heard the learned counsel for the petitioner and the learned Government Pleader for Land Acquisition.

Petitioner herein claims to be the absolute owner and possessor of agricultural land admeasuring Acs.4.75 cents in R.S.No.338/ 1 of Buttaigudem village of West Godavari District. According to him, the same is ancestral property, devolved on him. Alleging that the respondents are trying to dig Chintalapudi Lift Irrigation Canal across his land without following the due process of law, the present writ petition came to be filed.

When the matter is taken up, it is submitted by the learned counsel for the petitioner that canal has already been dug, as such, respondents herein may be directed to pay compensation in accordance with the provisions of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. In fact, in the affidavit filed in support of the writ petition, it is categorically stated that petitioner has no objection for allowing the respondents to acquire his land for public purpose. Obviously, the only grievance of the petitioner, as per the averments made in the affidavit filed in support of the writ petition, is with regard to non-payment of compensation.

Having heard the learned counsel for the petitioner and the learned Government Pleader for Land Acquisition, the writ petition is

disposed of directing the respondents to initiate action for the purpose of payment of compensation to the petitioner for the subject lands, and complete the same as expeditiously as possible, and pay compensation in accordance with law.

Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
