HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.33715 OF 2018 ORDER:
The present writ petition came to be filed to declare the action of the 3rd respondent in not considering the representation dated 30.07.2018, submitted by the petitioner, for issuance of Death Certificate of his grand father late Vaakapalli Subbaiah, as illegal and arbitrary. When the matter is taken up for hearing, learned Government Pleader for Revenue would submit that the 3rd respondent-R.D.O, is not the competent authority, to issue the death certificate of the grand father of the petitioner and it is only the Registrar of Births and Deaths, to issue the same to the petitioner and the petitioner may be directed to approach the said authority.
Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the petitioner to submit the application to the Registrar of Births and Deaths, through on line, under the relevant provisions of the Rregistration of Births and Deaths (RBD) ACT, 1969, within a period of two weeks from today, in which event, the authority shall deal with the same and pass appropriate orders in accordance with law, as early as possible, preferably within a period of two months, from the date of receipt of the on line application of the petitioner. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
