THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 4849 OF 2017 O R D E R :

The petitioner claims to be the owner and possessor of the building raised in H. No. 4-1-1/B & 4-1-1/F, in an extent of 746 square yards in Survey No. 199/2, Mahabubabad Village and Mandal, Warangal District, having constructed the same after obtaining permission vide proceedings, dated 18.09.2014. Now, the grievance of the petitioner is that the 3rd respondent, who is his neighbour, constructed the building without obtaining any permission. Though the petitioner complained of the said construction, by submitting the representation on 25.08.2017, the official respondents have not acted thereon so far. Hence, this Writ Petition.

Learned counsel for the petitioner fairly submits that since the petitioner has already submitted the representation dated 25.08.2017 to the respondent authorities, the same may be directed to be considered.

Heard learned Standing Counsel for the 2nd respondent municipality.

Considered the submissions made by the learned counsel on either side. In the fitness of things, it would be appropriate for this Court to direct the 2nd respondent to consider the representation dated 25.08.2017 of the petitioner and, if the allegations made therein are found to be true, take necessary action in the matter, in accordance with law. With this, the Writ Petition stands disposed of. No costs.

Consequently, the miscellaneous Applications, if any shall also stand disposed of.
