Heard Mr.A.Prabhakar Rao for petitioner, and Mr.N.Praveen Kumar for Respondent.

The writ prayer is one against inaction of Respondent in disposing of representation of the petitioner filed on 10.04.2012 as illegal, arbitrary and unconstitutional.

The sole Respondent filed counter-affidavit and submits that on being appraised by the Respondent that the plot area is since more than 300 sq. metres, the competent authority to grant, consider or refuse the building permission is the Director of Town Planning, the petitioner has collected the plan and papers, and taken way from the office of 1st Respondent.

Mr.Prabhakar Rao, learned counsel for petitioner, submits that he is unaware of all these details and requests the Court to place the stand of the Respondent on record and close the writ petition by leaving it open to the petitioner to obtain permission from competent authority. 5.

The request of the learned counsel for the petitioner is accepted and the writ petition is closed as no further order is necessary. As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs.
