HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.33668 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 2nd respondent in not deciding either revision or stay petition filed by the petitioner against the order dated 18.11.2017, passed by the 3rd respondent in D.Dis.E.No.872321/2017(D), as illegal and arbitrary.

When the matter is taken up for hearing, learned counsel for the petitioner submits that though the petitioner filed the above said revision along with the stay petition on 03.1.2018, the 2nd respondent did not pass any orders either in the revision or in the stay petition so far. Hence, the present writ petition came to be filed. Learned Government Pleader for Revenue, would submit that the authority may be directed to consider either the revision or the stay petition, in accordance with law.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 2nd respondent-Joint Collector, to dispose of the revision petition filed by the petitioner dated 3.1.2018 as against the order of the 3rd respondent in D.Dis.E.No.872321/2017(D), as early as possible preferably, within a period of three months from the date of receipt of copy of this order, in accordance with law, after giving reasonable opportunity of hearing to the petitioner and the concerned. If the 2nd respondent is of the opinion that the revision petition could not be disposed of within the time fixed, the stay petition filed along with the revision, shall be disposed of within a period of three to four weeks from the date of receipt of copy of this order.

With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
