HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 10101 of 2011 Order:

This writ petition was filed challenging the action of the second respondent in harassing the petitioner, her husband and his parents under the guise of registration of FIR No.74 of 2011 of Dundigal Police Station.

2. When the matter is taken up for admission, learned Government Pleader for Home, on the basis of written instructions, submits that the petitioner's mother approached the police of Dundigal Police Station on 15.02.2011 and lodged a complaint stating that her daughter, who is the petitioner herein and who was aged about 20 years, left their house situated at Suraram colony by stating that she was going to duty and did not return. Basing on the said complaint, a case in Crime No.74 of 2011 of Dundigal Police Station was registered under the head of woman missing and the investigation was taken up. He further submits that it is open to the petitioner to approach the respondent police and co-operate with the investigating agency, but as on 25.04.2011 the whereabouts of the petitioner are not known. He further submits that the present writ petition is filed on a mere apprehension.

3. As could be seen from the cause title of the writ petition, the petitioner married one P. Raguram and she is in private service. Since the petitioner is admittedly a major and five years have elapsed from the date of filing the writ petition, this Court sees no ground to entertain the present writ petition and if there is any apprehension of harassment from the second respondent, the petitioner is at liberty to approach the higher authorities.

4. Accordingly, the Writ Petition is dismissed. However, in the circumstances, no costs.

5. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
