This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction of the second respondent in disposing of the petitioner's appeal and stay application bearing No.Rc.C.S.3 Appeal No.329/2015 filed on 07.11.2015 challenging the proceedings of the third respondent in Rc.M.No.1152/2015, dated 29.06.2015 till today is illegal, arbitrary and against the violation of principles of natural justice and consequently to direct the second respondent to dispose of the appeal filed by the petitioner by suspending the impugned proceedings. Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.
A perusal of the record reveals that the petitioner herein filed an appeal challenging the order of the third respondent dated 29.06.2015. The appeal is pending on the file of the second respondent from November, 2015. The only relief sought by the petitioner is to direct the second respondent to dispose of his appeal in accordance with law.
In view of the submission made by the learned counsel for the petitioner, the second respondent is hereby directed to dispose of Rc.C.S.3 Appeal No.329/2015 filed by the petitioner in accordance with law, as expeditiously as possible, preferably within a period of one (1) month from the date of receipt of a copy of this order. Accordingly, the Writ Petition is disposed of. No costs. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
