THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO.642 of 2015 ORDER:

Upon hearing both sides, the Criminal Petition is disposed of at the admission stage with the following Order: As there is prima facie material in the FIR and the investigation is in progress, it is not a fit case to quash the proceedings. However, considering the fact that the petitioner/Accused No.3 filed O.S.No.175 of 2013 on the file of Senior Civil Judge, Nizamabad, and trying to vindicate his rights in respect of the same subject property and the matter is pending, the Police of I Town Police Station, Nizamabad, Nizamabad District, are directed not to arrest the petitioner/Accused No.3 during the course of investigation. The petitioner/Accused No.3 is directed to cooperate with the investigating agency for smooth completion of investigation.

As a sequel, miscellaneous petitions, if any, pending shall stand closed.
