THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 1032 OF 2015 O R D E R :

This Contempt Case is filed for willful and deliberate flouting of the Order dated 13.02.2015 passed by this Court in Writ Petition No. 3095 of 2015.

Through the Order dated 13.02.2015, this Court directed the 4th respondent therein to consider the Application of the petitioner submitted in Form-VI(A) on 16.07.2014 and pass appropriate orders thereon, within a period of three months, at any rate, before the end of April 2015.

Learned Government Pleader for Revenue placed on record the Memo dated 07.10.2015, by which the petitioner's claim has been rejected on the ground that the details of the subject land over which he is claiming right are not available in the relevant records.

Inasmuch as the Order of this Court is only to consider the case of the petitioner in terms of his entitlement and inasmuch a reasoned order has also been passed on 07.10.2015, nothing survives for adjudication in this Contempt Case and it is accordingly, closed.

It is however, made clear that the petitioner shall be at liberty to challenge the Memo dated 07.10.2015 by filing an Appeal. If he chooses to do so, the Appellate Authority shall keep in view the time consumed for prosecuting this Contempt Case, while dealing with the aspect of limitation.

Consequently, the miscellaneous Applications, if any shall stand closed.
