HON'BLE SRI JUSTICHE K. LAKSHMAN WRIT PETITION No.45660 of 2022 ORDER:

Petitioner is claiming that he is the absolute owner and possessor of land admeasuring Ac.5-00 gts., in Sy.No.170 situated at Budhakalan village shivar, Bellampalli Mandal, Mancherial District. In proof of the same, he has filed copy of old passbook. When Revenue officials are tried to interfere with his possession, he filed a writ petition vide W.P.No.8518 of 2021 and vide interim order dated 26-04-2021, this Court directed the parties to maintain status quo obtaining as on that date in all respects.

According to Sri A. Prabhakar Rao, learned counsel appearing for the petitioner, the said writ petition is pending and the aforesaid interim order is subsisting as on today.

Now, the grievance of the petitioner in the present writ petition is that respondent No.5 is not permitting the

petitioner to enter into the aforesaid property and trying to dispossess him without following due procedure laid down under law.

Whereas Sri B. Jangan Madhav Rao, learned Standing Counsel appearing for respondent No.5, on instructions, would submit that respondent No.5 never interfered with the possession of the petitioner and never tried to dispossess him as alleged by the petitioner herein. Recording the said submission, since the grievance of the petitioner is fictitious, this writ petition is closed. There shall be no order as to costs.

As a sequel, the miscellaneous petitions, if any, pending in the Writ Petition shall stand closed. __________________ K. LAKSHMAN, J December 22, 2022 PN
