THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 5071 of 2015 ORDER: (Per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) By this writ petition notice of demand dated 09.01.2015 asking for payment of property tax including penalty to the extent of Rs.2,50,889/- is challenged, and it has been stated that no prior notice was issued before the aforesaid notice was issued. Hence, the same is contrary to the provisions of law.
Learned counsel for the Greater Hyderabad Municipal Corporation says that the impugned notice is merely a notice of demand and it is not a final demand. However, he says that if the petitioner wants to file any representation/objection to the said notice, the Corporation authorities are ready to hear him. Under these circumstances, we dispose of the writ petition allowing the petitioner to file his representation/objection to the aforesaid demand notice treating the same as show cause notice, and if such representation/objection is made within 15 days from the date of receipt of a copy of this order, the same shall be considered and disposed of by the appropriate officials of the 1st respondent within a period of three weeks from the date of receipt of such representation/objection. In the process, speaking order shall be passed. If no representation/objection is made within the time stipulated above, the issue will be a closed chapter and the writ petition stands dismissed recalling our order. Pending miscellaneous petitions, if any, shall stand closed. No
costs.
