Heard learned counsel for the petitioners. There is no representation on behalf of the respondent.
The present writ petition came to be filed seeking issuance of a writ of mandamus declaring the action of the respondent in deducting crop insurance premium from the loans disbursed for the year 2011-2012 to the petitioners, as illegal and arbitrary, and consequently, to direct the respondent not to deduct any crop insurance premium from the loans to be disbursed to the petitioners.
By an order dated 27.08.2011, this Court, while issuing rule nisi, directed the respondent not to deduct crop insurance premium while disbursing agricultural loans to the petitioners, pending disposal of the writ petition.
At the time when the matter is taken up for hearing, the learned counsel for the petitioners submits that pursuant to the interim order dated 27.08.2011 granted by this Court, the respondent disbursed the loans to the petitioners without deducting the crop insurance premium. Now, the grievance of the petitioners is that the respondent may deduct the crop insurance premium from the loans to be granted in future. Since the loans granted in the year 2011-12 (as stated by the learned counsel for the petitioners across the Bar) were
released to the petitioners, without deducting any insurance premium, no cause would survive in so far as the first part of the prayer is concerned. In so far as the second part of the prayer is concerned, namely, deduction of crop insurance premium from the loans to be disbursed to the petitioners in future, it is left open to the petitioners to challenge the same, if crop insurance premium is sought to be deducted from the loans to be disbursed in future.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
Consequently, miscellaneous petitions if any pending in the writ petition shall stand closed.
