HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 33812 of 2018 ORDER:

1) Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the writ petition is disposed of at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.1 in not deleting the lands of the petitioner from the prohibitory list i.e., an extent of Acs.8.04 cents in Survey No. 1527, an extent of Ac.0.57 cents in Survey No.1526 and an extent of Acs.6.89 cents in Survey No.1536 totally admeasuring Acs.15.50 cents of Tadikonda village, Tadikonda mandal, Guntur District, under Section 22-A of the Registration Act, 1908, inspite of a direction by this Court in W.P.No.798 of 2016, dated 22.04.2016, declaring the said lands has not been covered under Section 22-A of the Act, as illegal and arbitrary.

3) It is to be noted here that the representation made by the petitioner dated 21.08.2018, seeking deletion of the lands from the prohibited list, was addressed to the Tahsildar - respondent No.2 with a copy marked to the District Collector - respondent No.1. 4) Having regard to the above, the petitioner shall make fresh application to the District Collector - respondent No.1, in view of the

endorsement made by the Tahsildar that he has no jurisdiction to delete the said land from the prohibited list, in which event, the District Collector - respondent No.1 shall deal with the same, in accordance with law, as early as possible, preferably within a period of three to four months from the date of making such an application. 5) Accordingly, this Writ Petition is disposed of. 6) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
