This Writ Petition, under Article 226 of the Constitution of India, is filed challenging the action of the respondents in not considering the application of the petitioner Dt.03.08.2018 in accordance with G.O.Ms.No.321, Dt.21.06.2018 and Circular CCLA's No.L.r.II/ RORII/ 511/ 2015, dt. 01.07.2018. Heard learned counsel for the petitioner, who submits that the petitioner has purchased the subject property from Smt B. Bala Tripura Sundari under unregistered document and by virtue of G.O.Ms.No.321, dt.21.06.2018 and Circular dt.01.07.2018, she is entitled for the validation of the document under the provisions of Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971, but the respondent are not disposing the application submitted by the petitioner.
Learned Assistant Government Pleader for Revenue, on instructions, submits that the petitioner was informed that her application could not be considered because of pendency of the present Writ Petition No.23822 of 2018.
Heard Sri Durga Prasad, learned counsel appearing for Smt Bala Tripura Sundari. Though Smt Bala Tripura Sundari is not made as a party, the learned counsel appearing for her in other Writ Petition No.23822 of 2018, submits that based on forged document, the said application has been filed.
In this case, it is to be seen that application of the petitioner is stated to be pending before the competent Court and even the competent authority as per the rules under Andhra Pradesh Rights in
Land and Pattadar Passbooks Act, 1971, has to issue Notice to the original pattadar. Since it is stated Writ Petition No.23822 of 2018 is disposed of, respondent No.3 is directed to dispose of the application of the petitioner after issuing notice to the owner of the land by name Smt Bala Tripura Sundari and after affording opportunity to both the parties to submit their objections.
With the above direction, this Writ Petition is disposed of. No costs.
The miscellaneous Petitions, if any, pending in this case shall stand closed.
