THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.33726 of 2018 ORDER:

Admittedly, the petitioner herein filed O.S.No.319 of 2016 on the file of the Court of the Principal Junior Civil Judge, Dhone, Kurnool District and in I.A.No.332/2016, the learned Principal Junior Civil Judge granted injunction. According to the learned counsel for the petitioner, the Court below extended the said injunction thereafter and the injunction order is still subsisting. When the matter is taken up, written instructions furnished by the Sub-Inspector of Police, Krishnagiri Police Station are placed on record by the learned Government Pleader.

The said instructions to the extent of their relevance read as under:

"It is submitted that earlier the petitioner herein filed W.P.No.31640 of 2017 for similar relief to register a case pursuant to the representation/complaint dated 14.06.2017 against the respondents 4 to 9 therein. In this connection, it is submitted that the petitioner had submitted a representation to the Superintendent of Police, Kurnool vide C.No.933/CCC/SP Camp/2017 dated 14.6.2017 to the Deputy Superintendent of Police, Dhone on 14.6.2017 for enquiry and necessary action and inturn the same ws entrusted to SubInspector of Police, Krishnagiri Police Station vide C.No.17/CCC/SDPO-D/2017 dated 14.06.2017 for enquiry and necessary action.

It is submitted that pursuant to the said endorsement, the SubInspector of Police, Krishnagiri Police Station had enquired into the matter and submitted a report to the Superintendent of Police, Kurnool on 31.7.2017, stating that the petitioner and respondents 5 to 9 having records on the land under Sy.No.615 admeasuring AC.4.50 cents, situated at Penumada village, Krishnagiri Mandal. Thus, there was a civil dispute between the petitioner and respondents 5 to 9 with regard to the above said land.

It is submitted that as per the station records, the respondent No.3 Station House Officer, Krishnagiri Police Station, Kurnool District did not receive the alleged complaint stated to have been lodged by the petitioner on 12.09.2018. It is submitted that whenever the petitioner

approaches the police station along with complaint, necessary action will be taken as per law."

Having regard to the above instructions, Writ Petition stands disposed of leaving it open for the petitioner herein to file a private complaint, if the petitioner is advised to do so. There shall be no order as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
