THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.31065 OF 2015 ORDER:

Heard learned counsel for the petitioner and Sri O. Manohar Reddy, learned Standing Counsel for the 1st respondent.

The petitioner herein is aggrieved by inaction on the part of the Senior Manager (Vigilance), South, Bharat Petroleum Corporation Limited (BPCL). Though BPCL is impleaded as the 1st respondent, the said Senior Manager is separately impleaded. The facts of the case are that with regard to the selection of a Retail Outlet Dealership for Petroleum Outlet for Tandur-Kodangal Road, Ranga Reddy District, there appears to be contest between the petitioner and the 2nd respondent. The 2nd respondent is stated to have been selected, which is objected to by the petitioner and the record shows that his complaint was examined and rejected by the 1st respondent as early as on 21.03.2013. The petitioner thereafter made a complaint to the Senior Manager (Vigilance).

On the said complaint, the petitioner was given a notice by the Senior Manager (Vigilance), dated 03.08.2015, requiring him to provide additional information/evidence. By way of further representation to the Senior Manager (Vigilance), dated 15.08.2015, the petitioner is stated to have complied with the said requirement. However, alleging that no further action is taken and no enquiry is held, the present Writ Petition is filed. It is submitted by learned Standing Counsel for the 1st respondent that though the petitioner's complaint was rejected on 21.03.

Vigilance Department conducts its own enquiry and submits report to the 1st respondent.

Learned counsel for the petitioner also states that after rejecting the complaint of the petitioner and in terms of the selection procedure, the 2nd respondent was already given letter of intent.

The notice of the Senior Manager (Vigilance), dated 03.08.2015, referred to above, required the petitioner to verify the complaint, which he has done under his representation, dated 15.08.2015. As such, if the petitioner's complaint is not already enquired into by the Senior Manager (Vigilance), he shall do so and communicate the result of his investigation to the 1st respondent, who shall, in turn, communicate the same to the petitioner.

With the above directions, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
