THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.27334 of 2015 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) It is stated before us that the issue arising for consideration in this writ petition in relation to the order dated 29.04.2015 passed by the Andhra Pradesh Administrative Tribunal at Hyderabad in O.A.No.8502 of 2013 fell for consideration before this Court in earlier writ petitions. A copy of the order dated 16.06.2016 passed in W.P.No.18780 of 2016 is placed before us and it reflects that following the decision in W.P.No.12899 of 2016, the Writ Petition was disposed of with directions. Another order dated 21.04.2016 passed in W.P.No.12686 of 2016 is also produced in this regard.

In terms of the above orders and for reasons alike as were mentioned therein, the Writ Petition is dismissed leaving it open to the authorities to hold a fresh enquiry on the basis of the same articles of charge by changing the Enquiry Officer and the Presenting Officer. If such enquiry is initiated, the same shall be completed expeditiously and in any event not later than three (03) months from the date of receipt of a copy of this order. Till such process is concluded, status quo obtaining as on today shall be maintained. The 1st respondent shall however be treated as continuing under suspension and shall be entitled to subsistence allowance during this period. If the process is not completed within three months, the 1st respondent shall be reinstated in service but the same shall be subject to the result of the disciplinary proceedings, if any.

Pending miscellaneous petition shall also stand dismissed. No order as to costs.
