THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13318 OF 2015 ORDER:

This criminal petition under Section 439(1)(B) of the Code of Criminal Procedure is filed by the petitioner/accused seeking to relax the condition imposed by order dated 14.07.2015, in Crl.M.P.No.2114 of 2015 and vide common order dated 21.10.2015 (30.10.2015) in Crl.M.P.No.4023 of 2015 and Memo in DDR No.8464 by the Additional Judicial First Class Magistrate, Vizianagaram, to the effect that the petitioner shall attend before the Deputy Superintendent of Police, CID, R.O., Visakhapatnam during working hours between 10.00 a.m., to 5.00 p.m., thrice a week instead of SHO, Kurupam.

Heard and perused the records.

Learned counsel for the petitioner submits that the petitioner has been suffering from backache and he has been taking treatment for the same and as such, prays this Court to relax the above mentioned conditions. Considering the facts and circumstances of the case, the condition stated above is modified to the effect that the petitioner shall attend before the Deputy Superintendent of Police, CID, R.O., Visakhapatnam between 10.00 a.m., and 5.00 p.m., on first Monday of every month for a period of six months. It is made clear that the condition that the petitioner shall continue to attend before the SHO, Kurupam, is hereby relaxed.
