This criminal Petition is filed under section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking the Court to quash the proceedings against the petitioner/accused No.2 in c.c.No .4628 of 2022, on the file of the learned Xlll Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, registered for the offences punishable under section 498-4 of IPC and sections 4 & 6 of Dowry Prohibition Act.

Heard Sri P.Animi Reddy, learned counsel for the petitioner/accused No.2 as well as Sri Jitender Rao Veeramalta, the learned Additional Public Prosecutor appearing for the respondent No.1- State.

when the matter is taken up for hearing, learned counser for the petitioner has limited his argument seeking a direction to dispense with the appearance of the petitioner before the Trial Court. 4.
The learned Additional Public Prosecutor submitted that appropriate orders may be passed.

Perused the record. C.C.No.462B of 2022 is pending on the file of the learned Xlll Additional Chief Metropolitan Magistrate, Nampally, Hyderabad. Considering the submissions made by both parties and in view of the facts and circumstances of the case, it is deemed appropriate to dispose of the Criminal Petition by dispensing with the appearance of the petitioner before the Trial Court. 6.
Hence, the Criminal Petition is disposed of dispensing with the presence of the petitioner before the Trial Court provided that the petitioner is represented through an Advocate on every date of hearing and that she shall be present before the Trial Court whenever her presence is specifically required during the course of trial 7.
