THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 14968 of 2015 ORDER:
Heard learned counsel for the petitioners and the learned Government Pleader for respondents 1 to 6.
2. The petitioners state that they are owners of an extent of Ac.3-01 guntas and Ac.1-00 guntas in Survey no.264/1/91/A, and Ac.0-34 guntas in Survey No.264/2/U. They claim title to the said land and they have been paying land revenue. They are also raising paddy crop in a part of the land. While so, under Mission Kakatiya, the 7th respondent is trying to construct a tank, on the orders of respondents 2 to 6.
3. It is needless to state that if the State wants private property for any public purpose, it has to follow due process of law. It is the case of the petitioners that no notice was issued to them while interfering with their possession of the property held by them.
4. In the circumstances, this writ petition is disposed of directing the respondents 2 to 6 to follow due process of law if the respondents 2 to 6 want any portion of the private patta land of the petitioners for any public purpose. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
