Heard Mr.D.Ramakrishna for petitioner and the Assistant Government Pleader for Home for respondents.

Petitioner complains against seizure of vehicle bearing Nos.TS 02 UA 8113 and TS 02 UA 8114 as illegal, arbitrary and unconstitutional.

The 2nd respondent is present and filed counter affidavit and explained the totality of circumstances till the date of filing of the counter affidavit.

I have perused the counter affidavit and I am satisfied that the 2nd respondent has followed the procedure in the case on hand.

Having regard to the orders this Court has been passing in the matters of seizure of Tractors/ Trailors, by following the same, this writ petition is disposed of as follows:

Since policy decision is taken in G.O.Ms.No.3 dated 08.01.2015 and G.O.Ms.No.15 dated 19.02.2015 for release of vehicle, the petitioner is given liberty to bring the same to the notice of the Court when his application is considered for release of vehicle. However, the respondents are also at liberty to release the seized vehicle by keeping in mind the competence and jurisdiction

to release the vehicle if it is already deposited with the competent Court.

As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs. _____________ S. V. BHATT, J 22-12-2016 Prv
