THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO CC.No.293 of 2016 ORDER :

This Contempt Case is filed alleging non-implementation of the order dt.26.11.2014 in WPMP.No.45089 of 2014 in WP.No.36021 of 2014.

In the said application, this Court passed the following order, viz., "There shall be interim direction to respondents 2 and 4 to forward the service Register of the petitioner to the office of the third respondent so as to enable R.3 to make necessary entries and to take consequential action.

Notice."

It is not in dispute that pursuant to the said interim direction, the respondent nos.2 to 4 in the Writ Petition did forward the Service Register of the petitioner to the Office of the 3rd respondent in the Writ Petition.

The counsel for petitioner contends that once it is forwarded to the 3rd respondent in the Writ Petition, the 3rd respondent was also directed to make necessary entries, and to take consequential action. 5.

This contention of the counsel for petitioner, I am unable to accede, because there is no direction to the 3rd respondent to make any entries and the order merely states that he may make necessary entries and take consequential action.

It is not in dispute that the 3rd respondent has passed an order explaining his inability to make the necessary entries as sought by the petitioner. The validity of said order would be considered while dealing with the Writ Petition.

As far as the Contempt Case is concerned, since the order passed by this Court insofar as directing respondent nos.2 and 4 in the Writ Petition to forward the Service Register of the petitioner to the 3rd respondent is implemented admittedly, there cannot be said to be any willful disobedience of the said order.

Therefore, the Contempt Case is closed. No order as to costs. 9.

As a sequel, miscellaneous petitions pending if any in this Contempt Case, shall stand closed.
