The present writ petition came to be filed seeking a writ of mandamus, declaring the action of the respondents 2 to 6 in sanctioning the package benefits to the existing leaseholders instead of the petitioners, in respect of the land admeasuring Ac.1-00 cents in Survey No. 102/ 1 of Taduwai Revenue village division, Jangareddygudem Mandal, West Godavari district, as illegal, arbitrary and improper.

The main grievance of the petitioner appears to be that the father of the petitioner was assigned the subject land and after his demise, the petitioner became the owner of the land and came to be in possession of the same. It is stated that during the lifetime of the father of the petitioner, certain extent of land was leased out to private persons, who are said to be in possession as on date. Now, the grievance of the petitioner is that the subject land has been acquired for Polavaram project, and the authorities are trying to disburse the benefits under the said scheme to the leaseholders of the land. It is stated that though the petitioner made a representation on 11.09.2018, to the 6th respondent, for grant of package benefits, the authorities are trying to disburse the benefits to the leaseholders, without considering his request. 3.
Learned Government Pleader would submit that if the representation of the petitioner is still pending, the same would
be disposed of at the earliest, after hearing all concerned, including the leaseholders.

Having regard to the above, the writ petition is disposed of at the admission stage with consent, directing the 6th respondent to deal with the representation of the petitioner dated 11.09.2018 seeking package benefits under the scheme of acquisition of his land for Polavaram project, in accordance with law, after hearing the petitioner and the persons who are said to be in possession of the subject property, at the earliest, if not already dealt with. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _________________________ JUSTICE C. PRAVEEN KUMAR 20.09.2018 DMG
