HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.13797 of 2016 ORDER :

This Criminal Petition is filed by the Petitioners/ Accused under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.249/ 2016 of Bhimavaram I Town Police Station, West Godavari District registered for the offences punishable under Section 420, 323, 506 read with 34 I.P.C.

2) Heard the learned counsel for the petitioners/ accused and the 2nd respondent-state represented by the Public Prosecutor before admission, before issuance of notice to the 1st respondent and perused the material on record.

3) Though the crime mentioned supra is outcome of a civil transaction and the alleged suspicion of cheating by deception from non-payment of the borrowed amount, for the Crime at nasal stage, this Court feels not to quash or stay the investigation, but for from entitlement to the concession of bail in the facts supra given disposal of this application giving liberty to the petitioners to surrender before the learned Magistrate and move for regular bail with notice to the A.P.P. concerned and in such an event, the learned Magistrate shall on hearing grant bail on the same day with necessary conditions. Needless to say any further remedy if at all after

investigation of the crime proceedings is left open to the petitioners.

4) With the above observations, the petition is disposed of. As a sequel, miscellaneous petitions pending, if any, in this criminal petition shall stand closed.
