Ap Bentho Oriya Samkshema Sangam, v. The State Of Andhra Pradesh

HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.33742 OF 2018 ORDER :

This petition is filed for a writ of Mandamus declaring the action of the respondents in cancelling the S.T.Caste Certificates issued earlier in favour of the petitioner-Sangam for Community Bentho Oriya in Srikakulam District, even though the enquiry with regard to the Bentho Oriya Community, is pending with the Committee, as illegal and arbitrary.

Learned Government Pleader for Social Welfare submits that the matter is in the nature of Public Interest Litigation and the petitioner-Andhra Pradesh Bentho Oriya Samkshema Sangam, is seeking a blanket order and it is not the grievance of an individual.

Learned Counsel for the petitioner-Sangam could not answer the question as to what is the personal interest of the petitionerSangam in the subject issue. More so, the writ petition is filed for the cause of several people, as such, the same is in the nature of Public Interest Litigation and this Court is not inclined to entertain the writ petition.

Accordingly, the writ petition is closed granting liberty to avail the remedy of PIL. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
