THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.17524 of 2017 ORDER:

In this Writ Petition, grievance of the petitioner is essentially against the unofficial respondents as they are undertaking construction in the subject land without obtaining any permission and proceeding with further under the guise of not taking action against them by the official respondents, though she filed complaints, dated 27.03.2017 and 10.04.2017. In the writ affidavit, the petitioner has fairly stated that with regard to partition of land admeasuring Acs.5.30 guntas in Survey No.87 of Kompally Village, Medchal Mandal and District, she filed O.S.No.707 of 2016 in the Court of XVI Additional District Judge, Malkajgiri, against respondent Nos.6 to 18 herein.

It is to be noted that the suit schedule property and the land in question is one and the same and that with respect to the partition of the land in question, the petitioner has already filed O.S.No.707 of 2016 before the Court below against the unofficial respondents and the same is pending, as such, in the said suit itself, she can seek the relief of injunction restraining the

CKR, J W.P.No.17524 of 2017 unofficial respondents from carrying out any construction in the land in question.

In those circumstances, no relief can be granted in favour of the petitioner in the present Writ Petition. Accordingly, leaving it open to the petitioner to workout the remedies before the Court below, the Writ Petition is closed. Miscellaneous Petitions, if any pending shall stand closed. There shall be no order as to costs.
