THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.33809 of 2018 ORDER:

It is submitted by the learned Counsel for the petitioners, during the course of arguments, that in response to the show cause notice bearing No.536/A2/2014-3, dated 03.09.2018, the petitioners herein submitted explanation on 17.09.2018. Copy of the postal acknowledgment is also placed on record by the learned Counsel for the petitioners. According to the learned Counsel for the petitioners, the said explanation is pending consideration. In view of the pendency of the said explanation, this Court deems it appropriate to dispose of the Writ Petition, with a direction to the respondents to consider the said explanation and to take further action and pass appropriate Orders, strictly in accordance with law. It is made clear that if there is no final permission in favour of the petitioners herein, they shall not undertake any aquaculture. It is also made clear that pending passing of the orders on the explanation, as stated supra, the subject tanks shall not be demolished. There shall be no order as to costs.
