This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS) by the petitioners, who are arrayed as accused Nos.6 and 7 in the event of their arrest in connection with FIR No.552 of 2025 of Narsingi Police Station, Cyberabad Commissionerate, registered

for the offences punishable under Sections 318(4), 338, 336(3), 340(2), 319(2), 238 and 61(2) of the BNS.

The brief facts of the case are that, on 19.03.2025, the defacto complainant, who is the Sub-Registrar, lodged a report before the police stating that, on 24.12.2024, a sale deed was executed in favour of P. Monesh involving the sale of 500 Sq.Yards of land in Plot No.112, in Survey No.146, Narsingi village. This sale was based on a previously registered Sale Deed Document No.1425/1967 and he suspected the authenticity of the parties and the validity of the documents and he instructed the Sub-Registrar for clarification and he received the clarification that it is a fake document. Hence, he requested for necessary action. Basing on the said complaint, the police registered a case for the above said offences against the accused and the petitioners/accused Nos.6 and 7 are the witnesses to the said fabricated document.

Heard Sri G. Bandaiah, learned counsel for the petitioners as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent- State.

The contention of the petitioners is that the petitioners herein are innocent of the said allegations and the only allegation against the petitioners is that they are witnesses to the fabricated document and they do not know anything about the facts of the case. Therefore, he prayed the Court to grant anticipatory bail to the petitioners.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the petitioners knowingly attested the document and they are also conspiracy in fabricated document, as such, they are not entitled for the bail. Further, the investigation was not yet completed and prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, the petitioners herein are accused Nos.6 and 7 and according to the the Investigating Authority, the petitioners herein attested the said fabricated document and accused Nos.1 to 3 were already arrested and released on bail. Considering the facts and circumstances of the case and also the role of the petitioners herein, this Court deems it fit to grant pre-arrest bail to the

petitioners/accused Nos.6 and 7, subject to the following conditions:

i.

The petitioners/accused Nos.6 and 7 shall surrender before the Station House Officer, Narsingi Police Station, Cyberabad Commissionerate, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/- each with two sureties, for the like sum each.

ii.

The petitioners/accused Nos.6 and 7 shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioners/accused Nos.6 and 7 shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till

the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
