THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE U.DURGA PRASAD RAO CI VI L REVI SI ON PETI TI ON No.6221 of 2016 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) This Civil Revision Petition under Section 115 C.P.C is filed by the judgment debtor in E.P.No.208 of 2016 in A.C.No.842 of 2013 on the file of the learned Principal District Judge, Rajamahendravaram. By the said order, the Executing Court issued a notice under Order XXI Rule 37 C.P.C to the petitioner/judgment debtor. We fail to understand as to why the petitioner/judgment debtor is before this Court instead of appearing before the Executing Court in response to the notice issued to explain his stand as to why he should not be subjected to civil arrest.

We accordingly dismiss the Civil Revision Petition with liberty to the petitioner/judgment debtor to appear before the Executing Court and contest the Execution Petition.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
