HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.72 of 2016 ORDER:

This petition is filed to withdraw O.P.No.1392 of 2015 from XV-Additional District Judge, L.B.Nagar, Ranga Reddy, and transfer the same to Family Court, Ranga Reddy, to be heard along with O.P.No.1611 of 2015 to avoid conflicting decisions.

2. Husband filed this petition and according to his affidavit, he filed F.C.O.P.No.27 of 2015 before Family Court, Karimnagar, for dissolution of marriage and the same was transferred to Family Court, Ranga Reddy on the request of respondent herein and renumbered as O.P.No.1611 of 2015. He stated that after disposal of transfer C.M.P. respondent herein filed O.P.No.1392 of 2015 and the same is pending before XV-Additional District Judge, L.B.Nagar, which is filed for restitution of conjugal rights. He stated that both the O.Ps. have to be tried by one Court to avoid conflicting judgments. For these reasons, he prayed for transfer of O.P.No.1392 of 2015 from XV-Additional District Judge, Ranga Reedy at L.B.Nagar to Family Court, Ranga Reddy.

3. Respondent did not file any counter.

5. Advocate for petitioner submitted that XV-Additional District Court, Ranga Reddy at L.B.Nagar, is now at

Miryapur and it is functioning as XV-Additional District Judge, Miyapur and the O.P. is also pending there with the same number.

6. Advocate for respondent submitted that she has no objection for transfer of O.P.No.1392 of 2015.

7. Considering the submissions of both sides, O.P.No.1392 of 2015 now pending at XV-Additional District Judge, Miyapur, is withdrawn and transferred to Family Court, Ranga Reddy, to be tried along with O.P.No.1611 of 2015.

8. Accordingly, transfer C.M.P. is ordered.

9. Miscellaneous petitions pending, if any, shall stand closed.
