HON'BLE SRI JUSTICE SURESH KUMAR KAIT CRIMINAL PETITION No.115 of 2017 ORDER:

The present Criminal Petition, under Sections 437 and 439 of Cr.P.C., is filed by the petitioner/A.2 seeking to enlarge him on bail in connection with Crime No.16 of 2016 of Jaddangi Police Station, East Godavari District, registered for the offence punishable under Section 8(c) r/w. Section 20(b)(ii)(c) of NDPS Act. Learned counsel for the petitioner submits that the mother of the petitioner expired on 07.12.2016, which is evident from the Death Certificate enclosed along with this petition, and the petitioner has to perform her last rites. He, therefore, submits that the petitioner may be released on bail for some time.

Keeping in view the above facts, the petitioner/A.2 in Crime No.16 of 2016 of Jaddangi Police Station, East Godavari District, shall be released on interim bail for a period of two weeks from the date of his release to enable him to perform the last rites of his mother on furnishing personal bond for a sum of Rs.15,000/- (Rupees fifteen thousand only) with two sureties for a like sum each to the satisfaction of the Judicial First Class Magistrate, Addateegala, East Godavari District.
