THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WP No.18584 of 2017 ORDER ::

This writ petition is filed under Article 226 of the Constitution of India to declare the action of respondents in opening the rowdy sheet against the petitioner, as illegal, arbitrary and violative of A.P. Police Standing Order 742 and contrary to the principles of natural justice and consequently direct the respondents to close the said rowdy sheet, duly considering the representation of the petitioner dated 06-6-2017. Learned counsel for the petitioner submits that this Court in similar facts and circumstances in WP No.4688 of 2012, dated 16-03-2017, relying on other judgments of this Court, gave liberty to the petitioner to filed explanation/ representation within two weeks from the date of the said order and the competent authority was directed to examine the same and pass appropriate orders. He submits that since the petitioner has already submitted his representation dated 06-06-2017, the same may be directed to considered and disposed of in accordance with law. Learned Assistant Government Pleader for Home, does not dispute the same.

Having regard to the facts and circumstances of the case and the submissions of the learned counsel, writ petition is disposed of directing the competent authority/ respondents 2 and 3 to examine the representation stated to have been made by the petitioner on 06-06-2017, in the light of the law laid down by this Court in W.P.No.4688 of 2012, which was disposed of on 16.03.2017 and in the judgments reported in SUNKARA

SATYANARAYANA v.

STATE OF ANDHRA PRADESH1 and B.SATYANARAYANA REDDY v. STATE OF ANDHRA PRADESH2, and dispose of the same in accordance with law, within a period of two months from the date of receipt of a copy of this order.

Interlocutory applications pending, if any, shall stand closed. No costs.
