THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.30288 OF 2016 ORDER :

It is the case of the petitioners that they are in occupation of house bearing No.4-126, Mahendra Nagar, Koyyalagudem, West Godavari District. They have also obtained electricity service connection and living therein for the last 10 years. However, the respondent authorities, without issuing any notice, are trying to demolish the petitioners' hut. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue appearing for respondents 1 to 4 and learned Assistant Government Pleader for Roads and Buildings for 5th and 6th respondents. In view of facts and circumstances, this writ petition is disposed of directing the respondents not to demolish the structures of the petitioners, without following due process of law. It is open for the petitioners to ensure that the petitioners does not encroach any government land.

There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition, shall stands closed.
