THE HON'BLE SRI JUSTICE K.C. BHANU WRIT PETITION No.14678 of 2015 ORDER:

The relief sought in the Writ Petition is as follows: "...........declaring the action of the Respondents in seizing the lorry bearing Andhra Pradesh 07TU0801 belongs to the petitioner on 10.05.2015 without following the procedure prescribed under Andhra Pradesh Scheduled Commodities Dealers (Licensing, Storage & Regulation) Order 2008, and trying to sell the seized lorry while pending 6A case as arbitrary and illegal consequently direct the respondents to release lorry bearing No.AP 07 TU0801 on bank guarantee."

As the alleged vehicle has been seized by the authorities concerned, there is no impediment for releasing of the same provided the petitioner furnishes bank guarantee.

Hence, the Writ Petition is disposed of permitting the petitioner to approach the authorities concerned for furnishing bank guarantee to the value of the vehicle to be estimated by them for releasing of the same. Consequently, the miscellaneous applications, if any pending shall also stand disposed of. No order as to costs.
