HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4682 of 2015 ORDER:
This criminal petition, under section 438 of the Code of Criminal Procedure, is filed by the petitioner-Accused No.3 seeking grant of anticipatory bail in connection with crime No.87 of 2015 on the file of I-Town Police Station, Vijayawada, registered for the offences under Sections 8(a) (c) & 20 (b) of the Narcotic Drugs and Psychotropic Substances Act. The case of the prosecution is that on credible information, the Sub-Inspector of Police, I-Town Police Station, Vijayawada, conducted vehicle checking at Vinayaka Temple and found one Musiya Diya along with A2 and A3 transporting dry ganja in a Maruthi Esteem Car. Thereafter, the police arrested those persons along with the car and registered a case in Crime No.87 of 2015. Heard and perused the material available on record. A perusal of the record discloses that the seized ganja is about 88 kgs, which is a commercial quantity. Hence, this Court is not inclined to grant bail to the petitioner at this stage. However, the petitioner is at liberty to renew his request after a period of twenty (20) days.
