HON'BLE SRI JUSTICE U. DURGA PRASAD RAO CRIMINAL PETITION No.2747 of 2013 ORDER :

Heard.

The present petition is filed under Section 482 Cr.P.C. by the petitioners/respondents 4 and 5 seeking to quash the proceedings in D.V.C.No.168 of 2012 on the file of Special Mobile Magistrate, Guntur.

2. The submission on behalf of petitioners is that the 1st petitioner is the married sister of respondent No.1 in the D.V.C. and the 2nd petitioner is her husband and they have nothing to do with the family affairs of the petitioner and respondent No.1 in the D.V.C. but they are unnecessarily impleaded as respondents 4 and 5 in the D.V.C., and therefore, the proceedings against them may be quashed.

3. Notice to respondent No.1 has not been served. In these circumstances, the petitioners are given liberty to approach the trial Court and file counter and take all pleas which are legally permissible to them and contest the matter and establish their innocence, if any. The presence of petitioners/respondents and in D.V.C.No.168 of 2012 is dispensed with except on the occasions when the trial Court specifically requires their presence.

4. This petition is disposed of accordingly. As a sequel, pending miscellaneous applications, if

any, shall stand closed.
