THE HON'BLE SRI JUSTICE K.C.BHANU AND THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION No.14810 of 2015 ORDER: (per Hon'ble Sri Justice K.C.Bhanu) This Writ Petition, under Article 226 of the Constitution of India, is filed to declare the proceedings No.MDK-549/PCB/TF-BO/2015-279, dated 13.05.2015 issued by respondent No.1, ordering closure of the petitioner industry as being arbitrary and illegal and consequently, to set aside the same.

2. Heard.

Admittedly, against the impugned proceedings, the petitioner filed an appeal before the Appellate Authority under Section 28 of the Water (Prevention and Control of Pollution) Act, 1974 and Section 31 of the AIR (Prevention and Control of Pollution) Act, 1981 at Hyderabad along with an application for suspension of the impugned proceedings.

4. Therefore, the Writ Petition is disposed of directing the Appellate Authority to dispose of the interlocutory application filed by the petitioner in the appeal within a period of two weeks from the date of receipt of a copy of this order.
