HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.2586 of 2017 ORDER:

This criminal petition is filed by the petitioner/ A.4 under Section 439(1)(b) of Cr.P.C., to relax the conditions imposed by the Special Judge for trial of cases under SCs & STs (POA) Act, in Crl.M.P.No.253 of 2017 dated 01.03.2017, directing the petitioner to appear before the SHO of Kurnool Taluq PS on every Thursday between 5 and 7 p.m. and mark his presence for a period of one month or filing of the charge sheet, whichever is earlier.

2. The petitioner filed Crl.M.P.No.383 of 2017 before the Sessions Judge for relaxation of the conditions and the same was dismissed by order dated 16.03.2017. The present petition is filed seeking the same relief to relax the conditions.

3. In the order dated 01.03.2017 in Crl.M.P.No.253 of 2017, the Special Sessions Judge directed the petitioner to mark his presence for a period of one month or till filing of the charge sheet, whichever is earlier. The said order was passed on 01.03.2017 and one month was expired by 01.04.2017. Thereby, the petitioner is not required to comply with the conditions imposed in Crl.M.P.No.253 of 2017. Hence, no order need be passed by this court at this stage. Consequently, the petition is liable to be dismissed.
