ORDER
The petitioner, who is the sole accused, filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with Crime No.233 of 2014 of Sangareddy Town Police Station, Medak District, registered for the offences punishable under Sections 406 and 420 IPC.
2. The averments in the report given by the DM & HO, Medak District at Sangareddy, disclose that the petitioner, in the name of Rural Diabetic Prevention Project, collected blood samples by taking an amount of Rs.350/- from each person, thereby cheating the public. Apart from that, the petitioner is alleged to have stated to the innocent public that he has recruited technical staff and doctors through the Government agency and that he is running the Institution for service. The enquiries made by the informant revealed that the petitioner did not obtain any permission from the DM & HO or from any of the authorities concerned before starting the said Institution. Basing on these allegations, the above report came to be lodged.
3. Heard learned counsel for the petitioner and learned Additional Public Prosecutor.

The present application seeking anticipatory bail was filed before this Court on 18.12.2014 and when the Court asked the petitioner to produce material showing his authority to collect the blood samples, the petitioner failed to produce the same. Today, when the matter came up for hearing, learned counsel for the petitioner produced an application for registration said to have
been presented before the Office of DM & HO, Sangareddy, on 12.01.2015 i.e., much after filing of the petition. Since the petitioner is running the Institution illegally without any permission from the authorities concerned and collecting money from the public, I am not inclined to grant anticipatory bail to the petitioner.
5. Hence, the Criminal Petition is dismissed. However, the petitioner, if so advised, can surrender before the Court concerned and move an application for bail after giving prior notice to the Public Prosecutor, which shall be dealt with in accordance with law.
