HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.3918 of 2015 ORDER :

This Criminal Petition is filed by the Petitioners/Accused Nos.1 to 5 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.371 of 2014 on the file of the IV Additional Chief Metropolitan Magistrate, Hyderabad registered for the offence punishable under Section 324 r/w 34 I.P.C.

2) Heard learned counsel for the petitioners/ accused Nos.1 to 5 and learned counsel for de facto and they want to compound the above offence and permission is thereby accorded as the parties stated that they have amicably settled the matter to purchase peace and permitted to compound the above offences.

3) As per the decision of this Court in Darapuneni Raj Kumar vs State of A.P, the offence is compoundable by entering the scope of Section 324 IPC to 326 IPC.

4) Having regard to the above, permission is accorded to compound the offence by invoking Section 482 Cr.P.C to subserve the ends of justice and as the defacto-complainant want to compound the entire case including and the proceedings are permitted to be compounded at the crime stage. Accordingly, the offences are compounded in terms of their compromise at the instance of the defacto-complainant since present.

4) Accordingly, the Criminal Petition is allowed and all the proceedings relating to Crime No.371/2014 on the file of IV Additional Chief Metropolitan Magistrate, Hyderabad are quashed. The bail bonds of the petitioners, if any, shall stand cancelled.

5) Miscellaneous petitions, if any pending, shall stand closed.
