This petition is filed to withdraw FC.OP.No.43 of 2014 from Family Court-cumAdditional District Judge, Anantapur and transfer the same to Family Court, West Godavari at Eluru.

Wife is the petitioner and according to her affidavit, after her marriage, respondent stated harassing her suspecting that she had extra marital relation with his brother. Having realized that respondent is intending to sell her to a brothel house, she came back to her parents' house and residing there. But the respondent intentionally filed FC.OP.No.43 of 2014 for restitution of conjugal rights. She further contended that she gave a report in Koyyalagudem Police Station and the same was registered as case in Cr.No.121 of 2014 and the investigation is pending. She further stated that she has a life threat at Anantapur in the hands of respondent and it is also difficult for her to go to Anantapur from Koyyalagudem. For these reasons, she prayed for transfer of FC.OP.No.43 of 2014 from Family Court-cum-Additional District Judge, Anantapur to Family Court, West Godavari at Eluru. Respondent inspite of granting time did not file any counter disputing the affidavit averments of the petitioner.

Heard arguments.

Considering the reasons stated in the affidavit and also considering the convenience of the wife, I feel that request of the petitioner can be considered. Therefore, FC.OP.No.43 of 2014 is withdrawn from Family Court-cumAdditional District Judge, Anantapur and transferred to Family Court, West

Godavari at Eluru for disposal in accordance with law. Transfer Petition is ordered accordingly. No costs. Miscellaneous petition, if any, shall stand closed. ____________________ JUSTICE S.RAVI KUMAR Dt.7th April, 2015 PNV
